Terms & Conditions

Effective July 2026

1 Provider and Scope of Application

1.1 These General Terms and Conditions apply to orders placed through the online store https://www.72k.ch/, which is operated by Viocap AG, Bahnhofstrasse 21B, 4106 Therwil, Switzerland, hereinafter referred to as “Viocap” or “we.”

1.2 The product offering is directed at consumers and, to the extent expressly provided for in the store, at business customers. A consumer is a natural person acting primarily for private purposes. A business customer is a natural person, a legal entity, or a partnership with legal capacity acting in the course of its commercial or professional activities.

1.3 Any supplementary or deviating terms and conditions of the customer shall apply only if we have expressly agreed to them in writing.

2 Offer and Conclusion of Contract

2.1 The presentation of products in the online store does not constitute a legally binding offer but rather an invitation to place an order.

2.2 The customer may add products to the shopping cart, review and correct their entries before submitting the order, and submit the order—subject to payment—by clicking the appropriately labeled button.

2.3 By submitting the order, the customer makes a binding offer to purchase the products contained in the shopping cart. The contract is concluded as soon as we expressly accept the order or ship the goods. An automatically generated confirmation of receipt merely documents receipt, unless it expressly states that the order has been accepted.

2.4 We store the contract-related information in accordance with statutory retention requirements. The customer receives the order information and these Terms and Conditions via email or on another durable medium.

2.5 The language of the contract is German. In the event of multiple language versions, the German version shall prevail to the extent permitted by law. Mandatory rules of interpretation of the consumer’s country of residence remain unaffected.

3 Products and Cosmetic Usage Instructions

3.1 The product description, net content, list of ingredients, and usage instructions as displayed in the online store at the time of the order are authoritative. Images may differ slightly from the delivered goods, particularly due to screen display or changes in packaging.

3.2 Cosmetic products are not medicinal products and do not replace a medical diagnosis or treatment. The customer must follow the instructions for use, warnings, and storage guidelines available at. If you have known allergies or sensitivities, check the current list of ingredients before use.

3.3 Individual skin reactions cannot be ruled out. If irritation persists, discontinue use and seek medical advice if necessary. This does not limit statutory rights arising from a defective or unsafe product.

4 Prices

4.1 The prices displayed at the time of order apply. For deliveries to Switzerland, prices include the applicable Swiss value-added tax, unless expressly stated otherwise.

4.2 For international shipments, the checkout process will indicate whether taxes, import duties, customs duties, and clearance fees are included in the final price. If a duty-unpaid shipment is expressly agreed upon during checkout, such amounts may be charged to the recipient. Mandatory price disclosure regulations of the destination country remain reserved.

4.3 Shipping costs and, if applicable, any other unavoidable costs will be displayed separately before the order is placed.

5 Payment

5.1 Only the payment methods displayed during checkout are available.

5.2 The purchase price is due upon conclusion of the contract, unless otherwise specified for the selected payment method. Payment service providers may apply their own terms and conditions and privacy policies.

6 Delivery

6.1 We deliver exclusively to the countries selectable during checkout and to deliverable shipping addresses.

6.2 The estimated delivery time may be specified with the product or during checkout. For prepayment orders, the delivery period begins upon receipt of payment; otherwise, it begins upon conclusion of the contract. Statutory delivery deadlines and rights in the event of delayed delivery remain unaffected.

6.3 Partial deliveries are permitted provided they are reasonable for the customer. Additional shipping costs will only apply if this was agreed upon prior to placing the order.

6.4 If a shipment cannot be delivered due to an incorrect or incomplete address for which the customer is responsible, Viocap may demand reimbursement for the reasonable, actual additional costs incurred. The customer may provide evidence that no costs were incurred or that the costs were lower.

7 Transfer of Risk and Transport Damage

7.1 For consumers, the risk of accidental loss or damage generally does not pass to the consumer until the goods are handed over to the consumer or to an authorized recipient designated by the consumer. Mandatory statutory provisions remain reserved.

7.2 Obvious damage incurred during transit should be documented with the delivery agent and reported to Viocap as soon as possible. Failure to make such a report does not affect the consumer’s statutory rights.

8 Retention of Title

The goods remain our property until full payment has been made, to the extent that a retention of title can be validly agreed upon under applicable law.

9 Cancellation and Voluntary Returns

9.1 For deliveries to Switzerland, there is no contractual right of withdrawal unless a voluntary right of return is expressly granted in the online store. Statutory rights arising from defects remain unaffected.

9.2 For consumers in the EU and the EEA, the cancellation policy and the model cancellation form in Appendix A apply. For consumers in the United Kingdom, the information in Appendix B applies.

9.3 A right of withdrawal may be excluded under applicable law, in particular for sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been broken after delivery. This exception applies only if its legal requirements are met in the specific case. Merely opening standard shipping packaging is not automatically sufficient.

10 Rights Regarding Defects and Shelf Life

10.1 The mandatory statutory rights regarding defects under the law applicable to the customer apply. With respect to consumers, these rights are not limited by manufacturer warranties or goodwill gestures.

10.2 The customer should report a suspected defect to [email protected], providing the order number and, if possible, a description and photos. For consumers, such a report is not a prerequisite for their statutory claims.

10.3 Changes resulting from improper storage, failure to follow usage instructions, or normal wear and tear do not constitute a defect, provided that the legal requirements for a defect are not met.

11 Coupons and Discount Codes

11.1 Promotional codes are valid within the specified period and subject to the published terms and conditions. Unless otherwise stated, they are non-refundable, cannot be applied retroactively, and cannot be combined with one another.

11.2 In the event of a full cancellation of an order, any discount applied will be forfeited on a pro rata basis; as a general rule, the amount actually paid will be refunded. Mandatory law remains unaffected.

11.3 For gift certificates purchased for a fee, the validity periods specified at the time of purchase and mandatory statutory limitation periods apply.

12 Liability

12.1 Viocap bears unlimited liability for damages caused intentionally or through gross negligence, as well as for damages resulting from injury to life, limb, or health, to the extent that an exclusion of liability is prohibited by law.

12.2 In cases of slight negligence, Viocap shall be liable, to the extent permitted by law, only for foreseeable damages typical of the contract in the event of a breach of a material contractual obligation.

12.3 Mandatory liability, in particular under applicable product liability and consumer protection law, remains unaffected. This provision does not limit any rights whose exclusion or restriction is prohibited by law.

13 Data Protection

Information regarding the processing of personal data, service providers used, international data transfers, and the rights of data subjects is contained in the separate Privacy Policy at https://72k.ch/de/privacy-policy/. These Terms and Conditions do not replace a Privacy Policy or any required cookie consent.

14 Intellectual Property

The content of the online store, in particular texts, images, product depictions, trademarks, and logos, is legally protected. Any use beyond the limits permitted by law requires the prior consent of the respective rights holder.

15 Customer Service and Complaints

Customers may contact us at Viocap AG, Bahnhofstrasse 21B, 4106 Therwil, Switzerland, email [email protected]. Complaints will be addressed within a reasonable timeframe.

16 Governing Law and Jurisdiction

16.1 Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the country in which the consumer has his or her habitual residence.

16.2 For consumers, the statutory places of jurisdiction apply. An exclusive agreement on the place of jurisdiction may be entered into with consumers only to the extent that it is permissible and valid under applicable law.

16.3 With respect to business entities, the exclusive place of jurisdiction is Therwil, Baselland, to the extent permitted. Viocap may also bring an action against the business entity at its general place of jurisdiction.

17 Final Provisions

17.1 Should individual provisions be or become invalid, the remaining provisions shall remain valid. The invalid provision shall be replaced by the statutory provisions. With respect to consumers, this rule applies only to the extent permitted by law.

17.2 The version of these General Terms and Conditions included with the order shall be decisive. Changes shall not apply retroactively to contracts already concluded, unless otherwise expressly and validly agreed.

Appendix A: EU and EEA Consumers

This Appendix applies to contracts with consumers who have their habitual residence in a member state of the European Union or the European Economic Area and who are supplied by Viocap as part of business activities directed toward that state.

A1 Mandatory Consumer Law

The choice of law in Section 16 of the Basic Version does not deprive the consumer of the protection afforded by mandatory provisions of their country of residence. In particular, mandatory rules regarding information, right of withdrawal, delivery, warranty, and legal remedies remain unaffected.

A2 Cancellation Policy for Goods

A2.1 Right of Withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you—other than the carrier—took possession of the goods. If multiple items from a single order are delivered separately, the period begins upon receipt of the last item. Mandatory national exceptions remain reserved.

To exercise your right of withdrawal, you must inform us, Viocap AG, Bahnhofstrasse 21B, 4106 Therwil, Switzerland, email [email protected], of your decision to withdraw from this contract by means of a clear statement, such as a letter sent by mail or an email. You may use the attached model withdrawal form for this purpose, though its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period expires.

A2.2 Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including the cost of the least expensive standard shipping option we offer, without delay and no later than fourteen days from the day we receive your notice of withdrawal. Additional costs associated with a more expensive shipping method you selected will not be refunded.

We will generally use the same payment method for the refund as was used for the original transaction, unless expressly agreed otherwise. You will not be charged any fees for the refund. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.

You must return or hand over the goods to Viocap AG, Bahnhofstrasse 21B, 4106 Therwil, Switzerland, without delay and no later than fourteen days from the day you notify us of your cancellation. The deadline is met if you ship the goods before the deadline expires.

You are responsible for the direct costs of the return shipment.

You are only liable for any loss in value if it results from handling the goods in a manner not necessary to assess their nature, characteristics, and functionality.

A3 Exclusion or Premature Termination

Provided that the legal requirements are met, the right of withdrawal does not apply, in particular, to sealed goods that are not suitable for return for reasons of health protection or hygiene if the seal was removed after delivery.

Before placing an order, the following information in particular must be clearly displayed: the seller’s identity, contact information, essential product characteristics, total price including applicable taxes, shipping costs, payment method, delivery time, complaint procedures, and information regarding the statutory right of cancellation. The contract confirmation is provided on a durable medium.

Statutory exceptions, particularly for certain sealed goods for reasons of health protection or hygiene, apply only if all statutory requirements are met.

B3 Statutory Rights

Nothing in these Terms and Conditions limits the statutory rights of UK consumers with respect to goods that, in particular, are not of satisfactory quality, are not fit for their intended purpose, or are not as described, to the extent that these rights are mandatory.

B4 Governing Law and Jurisdiction

The choice of Swiss law does not deprive British consumers of any mandatory protections to which they are entitled in connection with activities directed toward the United Kingdom. Statutory consumer jurisdiction remains unaffected.
